JVCKENWOOD USA Corporation (“JVC”) warrants to the original end-user purchaser (“Customer”) that its KM-IP8 8-NDI Input vMix Studio Switcher (“Product”) shall be free from defective materials and workmanship by conforming to the published technical specifications as of the date of shipment for a period of two (2) years from the date of purchase (“Warranty Period”). JVC makes no warranty with respect to external accessories used with the Product or to the software embedded onto the Product without limitation.
If the Product does not meet the warranty above during the Warranty Period, JVC may, at its option, replace the Product with a new or refurbished equivalent Product or repair the Product. Parts used for the replacement are warranted only for the remainder of the Warranty Period.
The Customer must notify JVC of any defect in the Product prior to the expiration of the Warranty Period. The Customer will be solely responsible for returning the goods to JVC. Upon acceptance of a warranty claim by JVC, where JVC repairs or replaces the goods, it will be responsible for reasonable shipping costs incurred in sending the goods to the Customer, provided that Customer is located in a country in which JVC has an authorized distributor or repair center or agent.
This warranty applies only to defects in workmanship and does not cover defects caused by:
- Neglect or accident;
- Product usage in other than the normal and customary manner;
- Improper or negligent acts or omissions;
- Repairs or attempted repairs;
- Tampering with or modification of the Product;
- Connection to incompatible equipment or power sources;
- Exposure to water or weather;
- Exposure to magnetic fields or corrosive liquids or substances; or
- Physical damage.
EXCEPT AS STATED IN THIS WARRANTY, JVC, ITS AFFILIATES, VENDORS, AGENTS, RESELLERS AND DISTRIBUTORS DISCLAM IN THEIR ENTIRETY ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. JVC AND CUSTOMER AGREE THAT CUSTOMER’S EXCLUSIVE REMEDY FOR ANY BREACH OF ANY SAID WARRANTIES IS AS SET FORTH ABOVE. CUSTOMER AGREES THAT IN NO EVENT SHALL JVC BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, OR EXEMPLARY DAMAGES WHETHER ON THE BASIS OF NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. THE TOTAL LIABILITY OF JVC ON ANY AND ALL CLAIMS SHALL NOT EXCEED THE PRICE ALLOCABLE TO THE PRODUCTS GIVING RISE TO THE CLAIM. The purpose of the exclusive remedies set forth above shall be to provide Customer with repair or replacement of non-complying Products in the manner provided above. These exclusive remedies shall not be deemed to have failed of their essential purpose so long as JVC is willing and able to repair or replace non-complying Products in the manner set forth above.
