JVC RATINGS AND REVIEWS SWEEPSTAKES
RULES AND CONDITIONS
- Sponsor/Vendor: The Sponsor of the JVC Ratings and Reviews Sweepstakes ("Sweepstakes") is JVC U.S.A., division of JVC Americas Corp. ("Sponsor" or "JVC"), 1700 Valley Road, Wayne, NJ 07470. The Vendor is Bazaarvoice, 11921 N. Mo Pac Expressway, Suite 420. Austin, TX 78759 ("Vendor" or "Bazaarvoice").
- NO PURCHASE OR SALES PRESENTATION NECESSARY. A PURCHASE OR SALES PRESENTATION DOES NOT IMPROVE YOUR CHANCES OF WINNING. Sweepstakes open to legal residents of the 50 United States and District of Columbia who are 18 years of age or older as of the beginning date of the Promotional Period, as defined below, possess valid government identification and have not won a prize within ninety (90) days preceding the Promotion Period in any other promotions sponsored by JVC. JVC employees, Bazaarvoice employees, each of their respective parent companies, affiliates, subsidiaries, divisions, licensees and advertising and promotion agencies (collectively "Sweepstakes Entities") and all of the above's immediate family members (parent, child, sibling, and spouse of each) and those living in the household of same are ineligible. Sweepstakes subject to all applicable federal, state, and local laws and regulations. Void outside the 50 United States/D.C. and where prohibited by law. \
How to Enter: Sweepstakes starts June 15, 2009, at 12:01:00 a.m. EST and ends July 15, 2009, at 11:59:59 p.m. EST ("Promotional Period"). Bazaarvoice's computer is the official time-keeping device for the Sweepstakes. During the Promotional Period, register for the Sweepstakes by submitting a complete product review ("Product Review") online at www.jvc.com. Sweepstakes entry requires user to create a free user account on www.jvc.com. One valid and complete Product Review as confirmed by JVC and uploaded onto www.jvc.com equals one Sweepstakes entry. Multiple reviews of the same product are not valid. "SPAM" or fraudulent Product Reviews will not be posted and all entries from said user will be void. Entrants may not submit Product Reviews with multiple e-mail addresses nor may entrants use any device or artifice to submit Product Reviews multiple times or as multiple entrants. Any entrant who attempts to submit Product Reviews with multiple e-mail addresses, under multiple identities or uses any other device or artifice to submit Product Reviews multiple times will be disqualified from participation in the sweepstakes, and all Product Reviews submitted by that entrant will be void. JVC and its agencies are not responsible for lost, damaged, misdirected, illegible or incomplete registrations, reviews, or entries nor for any change of email address, mailing address and/or telephone number of entrants.
- Number of Prizes Available, Prizes, Approximate Retail Value and Odds of winning Prizes: First Prize: JVC HD Everio Camera, Model GZ-HD300AUS. One (1) First Prize is available. ARV of the First Prize is $699.99. Second Prize: JVC Blu-ray Player, Model XV-BP1. Two (2) Second Prizes are available. ARV of each Second Prize is $299.95. Odds of winning a prize depend on the number of eligible entries received during the Promotional Period. No more than the number of prizes stated herein shall be awarded. Limit one monthly drawing prize per person/household/e-mail address.
- Winner selection/notification: A random drawing will be held on or before July 20, 2009 from among all eligible entries received during the Promotional Period to determine the monthly prize winners. Bazaarvoice will conduct the drawing and its decisions on all matters pertaining to the Sweepstakes are final. Potential winners will be notified by email. Potential winners will have five (5) business days to respond after receiving initial prize notification or the prize may be forfeited and awarded to an alternate winner. Potential winners may be required to sign an affidavit of eligibility (which affirms that they have complied with these rules) as well as a liability release, and a publicity release (where permitted by law), which if issued, must be completed, signed and returned within ten (10) business days from date of issuance or the prize will be forfeited and may be awarded to an alternate winner. If prize or prize notification is returned as undeliverable or in the event of noncompliance with these Official Rules, prize will be forfeited and may be awarded to an alternate winner.
- General Prize Restrictions/Total ARV: No prize substitution or transfer of prize permitted, except by the Sponsor due to prize unavailability. Taxes on prizes are the sole responsibility of winners. Acceptance of a prize constitutes permission for the Sponsor and its designees to use winner's name and likeness for advertising, promotional and other purposes in any and all media now and hereafter known without additional compensation unless prohibited by law. Winner acknowledges that neither Sweepstakes Entities nor their directors, employees, or agents, have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers' terms therefor, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. The total ARV of all prizes is $1,299.97.
- Limitation of Liability: The Sponsor, Sweepstakes Entities, Bazaarvoice, any internet access providers, and their respective parents, affiliates, divisions, licensees, subsidiaries, divisions, and advertising and promotion agencies, and each of the foregoing entities' respective employees, officers, directors, shareholders and agents (the "Released Parties") are not responsible for incorrect or inaccurate transfer of entry information, human error, technical malfunction, lost/delayed data transmissions, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, inability to access web sites, damage to a user's computer system (hardware and/or software) due to participation in this Sweepstakes or any other problem or error that may occur. By entering, participants agree to release and hold harmless the Released Parties from and against any and all claims, actions and/or liability for injuries, loss or damage of any kind arising from or in connection with participation in and/or liability for injuries, loss or damage of any kind, to person or property, arising from or in connection with participation in and/or entry into this Sweepstakes, participation in any Sweepstakes-related activity or use of any prize won. Entry materials that have been tampered with or altered are void. If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of this Sweepstakes and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, Bazaarvoice will conduct a random drawing to award all prizes from among all eligible, non-suspect, entries received prior to the time of the action or event warranting such cancellation. In the event of a dispute as to who submitted an online entry, the entry will be deemed submitted by the authorized account holder the e-mail address submitted at the time of entry. "Authorized Account Holder" is defined as the person assigned to an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. This Sweepstakes is governed by the laws of the State of New Jersey and all entrants hereby submit to the jurisdiction and venue of Passaic County, New Jersey for the resolution of all claims and disputes.
- Winners List: To obtain a list of winners for the prizes, send a self addressed stamped envelope to: JVC Ratings and Reviews Sweepstakes, 1700 Valley Road, Wayne, NJ 07470. Deadline for requests is July 1, 2009. Winners lists will be sent once all winners have been verified.
